1. Agreement Scope
This End User License Agreement (hereinafter referred to as “Agreement”) is a legal agreement between you (either an individual or an entity) and the licensor of Dimen Pro. By installing or using the software, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to the terms of this Agreement, do not install or use the software.
2. License
The software is licensed to you as a time-limited purchase with a subscription-based license. The license allows you to install and use the software on a single computer only for the duration of the subscription period. The license includes a full-feature trial period, but the following actions are strictly prohibited:
- Reverse Engineering: This includes but is not limited to any form of decompilation, disassembly, decryption, source code extraction, or any other analysis or alteration of the software’s structure, algorithms, or data formats.
- Sharing or Copying: This includes but is not limited to unauthorized copying, distribution, dissemination, or resale of the software.
- Transfer: You may not transfer, lease, lend, or sell the license to any other party.
3. Usage Restrictions
Each license is valid for use on only one computer. The licensor reserves the right to request proof of compliance with the license terms at appropriate times. If you need to use the software on multiple devices, a separate license must be purchased for each device.
4. Limitation of Liability
To the maximum extent permitted by law, the licensor of Dimen Pro shall not be liable for any damages, claims, or losses arising from the use or inability to use the software. This includes but is not limited to indirect, incidental, special, or consequential damages, data loss, business interruption, lost profits, or other financial losses, even if the licensor was advised of the possibility of such damages.
Errors and Functional Failures: The licensor is not liable for any damages or losses resulting from errors, bugs, functional failures, or inaccuracies in the software, including but not limited to losses or damages caused by the software’s failure to detect, report, or warn of potential issues. You are responsible for independently verifying the results produced by the software and for all consequences resulting from the use of the software.
The risk of using the software rests entirely with you, and the software is provided “as is” and “as available” without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
5. Information Collection and Privacy
You agree that the licensor may collect and store registration information during the software activation process, including but not limited to your name, company name, email address used during activation, and computer name. This information will be processed in accordance with GDPR regulations, and appropriate security measures will be taken to protect it. You have the right to request the deletion of your personal information, but the email address used for activation will be retained at a minimum.
6. Software Support and Updates
The licensor will provide support via web documentation and email. The licensor reserves the right to update the software at any time, including but not limited to bug fixes and feature enhancements. These updates will be provided free of charge during the validity of the license, but the licensor does not guarantee specific frequencies or forms of updates.
7. Trademark
Dimen Pro and its associated logos are registered trademarks of Dimen Pro in Taiwan. Except as expressly permitted in writing by the licensor, you may not use, copy, modify, or display the Dimen Pro trademark or its related logos in any manner. Unauthorized use of the trademark may be considered an infringement of the licensor’s trademark rights and could result in legal action.
8. User Feedback
The licensor welcomes feedback, suggestions, or reports of issues related to the software. Any feedback provided by you (including but not limited to suggestions for software functionality or reports of errors or defects) is given voluntarily and is not confidential. The licensor may use this feedback to improve or develop the software, without obligation to compensate you or assume any responsibility.
User feedback may be submitted through the licensor’s official channels, such as email or the official website. The licensor will strive to address and resolve reported issues in a timely manner but assumes no legal responsibility for any response or resolution.
9. Governing Law and Dispute Resolution
This Agreement is governed by the laws of Taiwan. Any disputes arising from this Agreement or the use of the software shall be submitted to the courts of Taiwan for resolution. If any provision of this Agreement is deemed invalid or unenforceable in a particular jurisdiction, such provision shall be considered severed from this Agreement and shall not affect the validity and enforceability of the remaining provisions.
10. Term, Termination, and Violations
This Agreement is effective as of the date you install or use the software and will remain in effect until terminated according to the terms of this Agreement. The licensor reserves the right to terminate this Agreement immediately in the event of any breach of the terms of this Agreement. Upon termination, you must cease using the software immediately and delete or destroy all copies of the software.
In the event of a breach of any provision of this Agreement, including but not limited to unauthorized reverse engineering, copying, sharing, or transfer of the software, the licensor has the right to terminate your use rights immediately and pursue legal action. Termination of this Agreement does not affect the licensor’s right to pursue any claims or responsibilities arising before termination. Following termination, the limitation of liability, trademark protection, and user feedback provisions will continue to apply and remain binding.
